I-140 amendment

Hi,
Congratulations on your I-140 approval !!!

I was laid off from one branch of a company but got the same job in anther branch. The company lawyer want to send a amendment letter for I-140. Did your processes start from the begining or from the receipt date of the previous I-140?

Sorry I did'nt get your question, but here is some info if it helps

My first I-140 was got approved in August 2001

My company merged with its sister concern in Jan 2002, but my attorney did'nt feel like I needed I-140 amendment for next 18+ months.

We filed our I-485 in April 2002 with old I-140(Approved in Aug 2001)

And in Sep 2003 my attorney decides to file I-140 amendment , which got approved today.

My I-485(Rd April 19th 2002) is still pending.

ThakurSahab,

Congratulations on your I140 amendment approval!

If I may ask you a technical question - how is an amendment to any of USCIS pending petitions can be done? You just file the same form again (e.g. I140 in your case) with the corrected information and attach a cover letter explaining all details, or there is a more formal way to amend a petition?
Like with federal tax forms, there is a special 1040X form to amend your previously filed 1040.

Thank you.

You are correct, you just file I140 again, there is no separate I-140 amendment form. In the cover letter you explain that it is amendment to existing I-140 petition, you will also explain the need for amendment, in my case it was company merger.

My lawyer also submitted supporting documents(affidavit from VP HR) for the merger, along with all other regular documents like - credential evaluation, educational transcripts etc.
