I-140/ 485 Stage

Hi,

I am on H1-B Visa and my husband had applied for our Green card and it is at the 140/485 stage. We are going through some difficult time and may get divorced in the next few months. What is going to happen for the application process? We have been married for 8 years. Will I be dropped off from his application or is it still valid? We had applied the 140/485 in May 2003

I have another application going through my work where I just got approved my labor certification. Should I cancel the application through my husband and go through my work or continue with my husband's?

Please advise.

if ur LC has been approved then I believe you should go ahead and file I-140 as independent. don't cancel anything through ur Husband. let it leave as in queue.

why?? because it won't hurt ur case..... if u think that u can wait till 485 filled before seperate/divc then you would get benefit once ur 485 is pending and then u got Divc/Sep by ur Hbd.

I believe by law u are very well protected once ur pettition is pending (485) and u then get sep/div. you won't have any issue. try to wait untill your 485 is filled by ur Hbd if u can wait bear.....

otherwise u have ur option with go ur I-140 route....
