I-140/485 Pending,H4-->H1 conversion

Hi,
Experts , please suggest.

My I-140/485 Pending(Appeal stage) for spouse also 485 Pending.And I am applying second labor GC process also.
I/Spouse have EAD/AP approved, but I/Spouse don't want to use EAD(I140 in Appeal stage).
My H1 is expiring on August 2005, I will apply for 7th year extn.
Now my wife wants to do job, so applying new H1 (H4--->H1),
My question is, if she gets new H1, how long it will valid?.Is it for 3yrs or upto my H1 validity period?.(She came 2yrs back on H4).

Please comment....

They can approve it for any amount of time less than or equal to 3 years. And she can extend it till next 4 years as she completed 2 years of her stay here on H4. Her approval of H1 would be independent of your H1 period. Her H4 is dependent on your H1 period and status.
