In Dec 2004, Came to US on F1 expiring in Sept 2008.
In Jul 1st week 2007, Got married back home and came alone in US on F1
In Jul 1st week 2007, H1-B approved effective Oct 1st 2007.
In Jul 2nd week 2007, Filed I-140 with spouse information.
In Aug 2nd week 2007, Filed 485 / I-765 / G-325 / G-28 also with spouse information.
In Sep 2007, got receipt for I-140.
I didn’t have receipt of I-485 yet.
I have few issues.
1-My Attorney made typo (Dropped Last character) in my first name on I-140 which was identified on receipt, and he is saying to get it amended once it’s approved to match with I-485. Is he correct can we do the amendment or I have to file the whole case again?
2-Can my spouse get H4 visa by showing my H1B Approval notice since I have not filed any petition for her? Note: I didn’t have H1B stamped yet. If yes, then is there any maximum time to enter in US after getting the visa?
3-Is it allowed to get H1B stamped after filing I-140/485? Or will I be allowed to enter on H1B?
4-What would be the earliest time to file for AP in the above situation?
