I am in my 6th year H-1B. I have a pending I-140 (EB1b) in TSC since April 2004. I would like to file I485 so my husband can also file his EAD. I know this is possible. Now, I also have a pending LC-RIR (just to be sure in case I-140 gests denied) in the regional level. My lawyer told me that it will be adjucated anytime soon. He was hoping we could file I-140/485/EAD soon so we won't have to extend my H1 which is expiring soon. Now, the question is, if I file I-485 based on the pending I-140 (Eb1b), and the LC is approved, can I file I-I-140 (EB3) and asked the I-485 to be "transferred " based on the new I-140 (EB3) application? I am more confident on the EB3 than on the EB1b.
