Hello Everyone:

I just filled for my Permanent residency a few weeks ago, I already got my receipts that my application is being processed. I'd like to leave the country for christmas and I was thinking about filling up the I-131 application, I was wondering if that's something easy to do/easy to be granted. or if I should just wait until I get all my documents before applying for it, instead of asking for advanced parole.

If I may ask, exactly what forms did you submitt?

You should have submitted the I-131 along with the original application package. :eek:

Unfortunately, you will not be granted AP before Christmas. It is too soon after filing. It usually takes USCIS to approveI-765 up to 90 days and AP up to 120 days. :o That is just a guideline.

Before Christmas? No way!
Maybe for President Day!

But if you hold a valid H or L visa you don't need AP.
 
I guess I missed that I-131 form, I thought you had to wait til you had your I-485 and I-130 processed in order to fill I-131. I submitted: i-485, i-765, i-130 (along with all the 325a and the prove of support one can't remember the name).
 
Also one more thing, let's forget about christmas, should I fill the I-131 now regardless? or should I wait until I get all my papers/cards back?

I think you can apply for emergency AP if you can show the need for it. Search it.
 
Ok, So I'm still confused. When should I apply for my I-131? that document I'm gonna need always to travel outside the country right? should I apply now while my application is being processed or should I apply after I got my application accepted?
 
Once you have been granted permanent residence (you have your green card or your passport stamped), there's no need for a I-131, unless you plan to stay out of the country for more than a year (then apply for a re-entry permit).
 
You can apply for AP at any time while your AOS is pending. Just include a copy of the I-485's I-797c, to make sure they associate it with your AOS case.

Christmas is a long shot at this point, but not out of the question if you feel you qualify for emergency AP. You would have to make an infopass appointment, and demonstrate to a CO that you have an urgent need to travel. It's almost entirely discretionary, so it's up to you to bring any paperwork you feel might help.

The only thing I'm not sure about, is whether you can actually both file the I-131 and request emergency AP at infopass. They may only be able to expedite a pending I-131. Not sure. Best of luck!
 
Best bet is for you to go File for Emergency Travel, It is vaild for one day with a timelimit, yes it will cost you $180.00 and you will have a certain time to cross the border back to the U.S. if you fail to cross by that certain time they give you, then you will be pentalize and may be banned.

To file for Emergency Travel you have to go to your local service center and show why there is an emergency and you pay there. Go to USCIS.GOV for more information.

P.S. you wont be able to get an Emergency Travel for Christmas, id wait a few days after or before...good luck :).
