I got my GC through my previous employer, under the EB-2 category. We landed as immigrants in February 2011. Now we are going to apply for I-131 REP.
Could USCIS deny our I-131 as it's employer sponsored immigration? (On the basis that I was given the immigrant visa because a US Employer needed my skills) I am on E-21 immigrant visa and dependents are on E-22.
Is there anything that I would be required to furnish from the US employer when I file for I-131? I understand I need to get the consensus from the employer that I can postpone my move for next 2 years. Would I need this in writing from them? And if so, would I have to submit or carry it with me at the time of Biometrics???
