I'm filing an I-130 to sponsor my husband who entered on an H1B but got laid off recently. The last time he entered the country he had an I-94 from his job before last, then he switched jobs and got a new I-94 number and authorized stay date. He hasn't left the US since though, so never re-entered the country using the new i-94. My lawyer told me to use the i-94 from when he last entered the country, but the expiration of the authorized stay date on that one was like a year ago. When he switched jobs his authorization of stay date got extended to this november. Do I use the arrival/departure record of the old i-94, and use the authorized stay expiration date of the new one? Or both the record # and expiration date of the old i-94? Or the record # and stay date on the new i-94?
