Hi, I have a question regarding entering the US while someone's I-130 application is pending. My dad has an I-130 pending and wants to come on a visit. He has a B-2 visitor visa valid till 2008. I understand it's at the discretion of the CBP officer at the port of entry. Has anybody had any adverse experiences with this situation. I know they will question but can they/will they send the person back?
My dad is not on a 485 so advance parole isn't an option. He is abroad while his I-130 is being approved.
