I-130 Married to green card holder

hi all,new to this great forum and frankly for any forum at all, I need your help,i have an appeal case with BIA for my overstay for my B1 visa to take CPA exams and last year i got married,my wife is a green card holder not usc so i applied only to i-130 with uscis and my lawyer said that no action we can take in our appeal till i get i-130 decison,i am accountant and passed cpa exam so i am very keen to have ead and ssn in order to work in my career and afford my home and life expenses so do you think i can apply for ead with BIA after i get i-130 decision.

You will take around 4 years to get a green card (time counted from filing of I-130). You cannot get SSN or EAD until a visa is available (in ~4 years). You also cannot legally stay in US while you wait for your turn.
 
thanks for the reply,my wife will be usc within one year so i will be immediate relative at this time,my lawyer said as long my case is pending with th court of appeals i have stay of removal,what really concerned me is the EAD which you stated that i will not be able to get it so thanks for your reply in that matter.
