I am a US citizen and filed an I-130 for our son in Jan 2004.
My husband is a PR, can he petition for our son as well? Or is this a waste of time?
Thanks.

You said your husband is a PR well he cannot petition for your married son.Only citizen parents can do that so when he becomes citizen let him do it for one cannot predict life who will bow out first.

If he is the Father, then he can petitioned for him. He will then fall into the F2B category, which takes about 10 years. Since you are a U.S. citizen, he is in the F1 category, and they are currently processing applicants who filed before April 22, 2001. There has been no movement in that category for over a year, but keep your fingers cross they will soon start again.

Well if you afford two applications for him, go ahead if you can get it.

Thanks for your reply Thera33, appreciate it!
My husband, daughter and myself moved over here from UK and our son who was 21 at the time decided to stay on and finish his university degree, I became a naturalized citizen 3 years ago and decided to sponsor him.
At the time we didn't know that we could have sponsored him as LPR's .....
Anyway wasnt sure if husband sponsors him if it would affect the I-130 already filed.. but as you say it could take 10 years that way so might just keep our fingers crossed for the I-130 already filed.
