Hi Folks,
We had started the process of filing GC for my Mother in Law in March 2002. The I-130 was filed online.
Now getting ready to file I-485, there has been a question asked by USCIS that why was the I-130 started before 90 days. The I-485 is yet to be filed.
She arrived in US in Feb 2022, the I-130 got filed by March end which was a mistake.
We were not aware of the 90 day rule, used the same process that i did for my mother in 2016. Looks like the 90 day rule came into effect sometime in 2017.
1. How to respond to the query of why the I-130 filed before 90 days, it was an oversight on our part. I hope not to have her application or visa cancelled.
2. Is there any legal help available to tackle the above scenario, are there any good immigration lawyers we can reach out to?
3. What is the typical charge to represent my MIL for I-485, any recommendations.
Please let me know of any suggestions to correct the above scenario.
