I-130 Family First - Beneficiary Marital Status Update

Hi Guys

My mother is US citizen and my I-130 is approved and curently my preference category is family first...if my mother has to include my spouse name in existing petition approved in Nov 2002 what kinda form she has to fill in...some people are saying that she might have to fill another I-130 form, if she does so then will USCIS treat new I-130 as fresh application for petition with diffrent priority date or only my spouse name will be added to existing petition with same priority date.

am really in mess it would be great help if somebody could share his/her experience with me on this matter.

Hi,
if you got married after your mother became a citizen then you can retain your original priority date (NOV 2002 if I understood it correctly) under Fb1, but now your application is under Fb3 (Married children of citizens). Current priority date for FB3 is May 08, 2000 a little less than 2 years behind Fb1.

After I became a US citizen in 2004, I applied to USCIS with copy of my naturalization, so my son became Family 1 category and case was approved and moved to NVC.
After few months he got married, So my lawyer said me to send copy of his marriage certificate translated and my letter of explanation to NVC.
We did not have to apply with another 130, PD still the same.
Now he is in F3 category.
Is your petition approved?
 
If you married AFTER your mother became USC, then it is Ok. But you already lost your priority with your marriage. Your mother has to send marriage certificate copy with a letter of explanation, to NVC-National visa center.
Your PD is the same, but category will be FB3.
 
Many Thanks...yeh my mother was USC when i got married. i have another problem when my father applied my passport he mentioned my place of birth Amritsar(This is District) but on my birth certificate it is mentioned "Majitha"(Town Name) this town comes under same district that is "Amritsar". so will it be problem?
 
Probably won't be a problem, but when you file for AOS you could attach a sheet to your birth certificate explaining the difference if you feel it is important. As far as I remember, a copy of this page of the passport doesn't even have to be submitted, only your visa page.

EDIT: Looks like I just joined the 1000 post club. Not sure if I should really be proud of that ... :p
