My brother is in India applied for H1B (querry pending).
I'm a US citizen. Will it be a problem if I start the I-130 Family F4 category (wait time 12 years for India) immigrant visa at this time? As he is process of getting non-immigrant visa or already in US as non-immigrant H1B. I would like to know if H1B (non-immigrant visa) and I-130(immigrant visa) can be active at the same time and H1B transfer will be an issue as I-130 is pending. Thanks
