I-130- F3 Category

Hello,

My mother, a citizen, applied for my married brother (F3 cateogry) back in 2016. After 8 years, the status is still the same and shows case received. The receipt is all we have. Is there anyone here with a similar or different experience with the F3 cateogry? The case was filed in the California center.

Processing time for this category /service center from receipt to approval is mostly finished in 78 months (6.5 years), however some can take much longer.
check processing times: https://egov.uscis.gov/processing-times/
If you scroll down on this page to “When can I ask about my case?” and enter exact petition date, it will give you the earliest you can file an inquiry for case outside normal processing time. If I use May 2016, it returns “Your case is processing normally. The earliest you can submit questions is March 24, 2025. Please do not contact us before this date. ” So in other words, your brother doesn’t need to worry. (In fact, if your brother has children, the longer it takes to approve the petition the better it is, to help prevent them aging out.)

Bear in mind that regardless of when USCIS approves the petition, he cannot get a visa until the priority date (petition filing date) in 2016 becomes current. At the moment, for most countries, F3 cases are only current to March 2010, so it’s likely to be another 6 years or so before he can interview for a visa. They’ll contact the petitioner about a year before expected current for imterview date to prepare by getting and submitting the relevant documemts, etc for the visa.
