I-130 denied and my appeal dismissed by the BIA

Petition to classify status of alien relative for issuance of immigrant visa

The director found that the petitioner's burden had not been met because of discrepancies discovered during September 1,2011, interview. specifically, the director noted that the petitioner had no knowledge that the beneficiary was in removal proceedings, knew very little about the beneficiary, including information about his culture, educational background and the beneficiary's mother name in addition petitioner was not familiar with the person who submitted the beneficiary's affidativ of support.

Of course, the petitioner may file a new visa petition on behalf of the beneficiary that is supported by competent evidence that the beneficiary is entitled to the status sought under the immigration law.

please can someone help me what is the next and i dont know what to do. because as you see they just say you may apply new visa petition but how and can i apply with 1485 and i130 ,EAD

Get an attorney! The blurb you posted here is not enough for anyone to help you. Any case going through the courts at this level is not one you would be soliciting advice for on an anonymous online forum.

If you truly treasure the opportunity to stay in this country, then stop being cheap and get an immigration attorney. I got to confess though that from the little you wrote, it appears to me that your case would be as weak as tea made from a twice used tea bag. In American sports parlance, you're gunning for a Hail Mary pass!!

thanks your advise

I had attorney that why i dont trust them anymore. you think that they are the power they will do anything.

when my case dismissed by the BIA, my attorney even doesnt call me. i called her and she doesnt want to give me any advise because she want to get hired again for new case.

i tired to pay attorney at this country.
