I-130 APProved-petition not sent to NVC

Hi everyone,

My petition for my wife was approved on June 14, 2005 and I received a approval notice from USCIS stating that the petition has been approved and we have sent the petition to National Visa center. Since then I have become a US Citizen and I called NVC to ask them to upgrade my petition to IR1 from 2A so that my wife can file an adjustment of status.

I sent a request to NVC and their letter came back saying that they were unable to locate my petition and I should refer back to USCIS. I called USCIS and they told me to fax the approval notice and what I sent to NVC.

I am a little confused and frustrated that my petition was approved on JUne 14 2005 and it has not reached NVC till now. I applied to upgrade my petition on April 24, 2006 and they sent a reply on May 9.

Where could my petition be?
What are my options.
This is delaying my wife's adjustment of status?
Please help!!!!!! :(
 
Sometimes the petition may get misplaced when USCIS sends it to NVC. However my understanding is that USCIS always has copy of your petition. Receiving petition at NVC is required for CP, however you are also talking about AOS. I think you can proceed with filing I485 package (for wife of USC if she is in USA), alongwith copies of I130 approval, notice of upgrade. You may just want to check with USCIS (call or Infopass).

Separately, if you wish to proceed with CP, I guess you will have to follow up with USCIS (Infopass) and have them send I130 again to NVC.
