Hey there

Can any1 help me with a question regarding my current immigration status from the Uk to the states. I've filed an i-130 & 485 on april 2001. I've received notice that the i-130 was approved, however, i'm unsure if i'm now waiting for a green card from when this was approved or 1st filed? Presumably this is from when this was 1st filed? i've tried searching for an answer but to no avail? This process has irritated me greatly as it's taken 5 yrs to get this approval, i'm hoping that i've not another 10 yrs to wait till a green card becomes available - i'm hoping that it is 2001 which is only 4 yrs or so. Any answers would be appreciated.

Did you file on the basis of US Citizen spouse or permanent resident spouse ?timelines vary accordingly ..& did they tell you what is I-485 waiting on ? Or did you have interview yet ?

Thx

My father filed (He's a Permanant resident - The I-130 was for a lpr over 21).

I believe when I originally filed for the I130 the 485 was filed also. I had just received notification that my case was approved but was informed by immigration officers that until a green card becomes available i'm basically stuck. I understand that at present the Visa bulletin says they are dealing with green cards dated Feb 97 (this increases month by month) but am unsure if I'm waiting from 97 to 2001 when I originally sent in the I130 i.e. 4 yrs or now that this has been approved? I will not be able to get an interview until a green card is available to me - What i'm unsure about is whether i'm waiting for 4 years or 10?

I hope this makes more sense.

OK. Let me get this straight. So, your father (not you) filed I-130 for you in April 2001, and he was a permanent resident at the time. You shouldn't have filed I-485 concurrently: you had to wait until your priority number was current, and you had to wait outside of United States, unless you had a legal status in U.S.. Currently, the visa bulletin is showing the year 1997 for B2 category - LPR applying for unmarried son/daughter. That means you have to wait for 4 more years. However, if your father becomes a citizen, and upgrades his petition, you would be in the family first category which will allow you to apply immediately, since the current date for the first category is 22APR01.
