I-130 Approval

Hi,

I am have been living in the US for over 10 years under an F1 visa. My brother is a US citizen, and he applied for my Green Card. My I-130 got approved in November 2015. I am from Nepal. Is there anything else that I need to do? How long do I have to wait and how will I get informed?

Thanks for reading.

When did your brother apply for you ? The priority date (date the petition was properly filed) is the critical date, rather than the approval date.

The actual date is important, so I’d suggest you ask your brother to check the case and confirm the dates. In any case, if it is March 2015, you still have a very long wait - your priority date needs to be “current” in the monthly visa bulletin for a visa to be available. The latest visa bulletin has sibling visas (F4) current only to 22 Sept 2006 (see the last line in Table A here https://travel.state.gov/content/tr...in/2020/visa-bulletin-for-september-2020.html - Nepal will fall under “All Chargeability Areas Except Those Listed”). So there is likely another ten years to go, possibly even longer.

Update: My EAD is going to expire soon. My work applied for H1B (non-profit) and it has been approved.

Since I am already in the US, should I file for I-485? Is it going to help? Is there a way to accelerate the process?

Should I just apply for EB-2?
