I-130 ang my pending labor cert.

Hi All,

Here is my case:
1.I am H1B holder with pending labor cert. application (4 years now still pending).
2.I am 30 years old and married with a US born daughter
3.My Visa as H1b Holder is valid till Aug 2005.
4.My father is a US Citizen

My question are, 1.How can i take advantage of my father citizenship?, (he planning to petition me)
2.If i have a pending I-130 petition and my labor cert. didn't approved what then is my status? can i still work or get EAD.
3.Can i file I-130, EAD and I485 at the same time?

I would say the first step is to check with your attorney or local office on your labour clearance as 4 years is way too long.

If your father petitions for you, it will take much longer for you to get your visa.

Hope that answers your questions... How do you have I130 is employment based category?????
