I 130 and I 129 approved same time. got interview date for 129. what to do?

Hi all,

I am a US Citizen, naturalized in february 2009.
My wife and my 4 month old daughter are in India.

I filed my wife's I130, in november 2006, when i was an LPR(Green Card Holder). I upgraded the petition, after becoming citizen and it got approved rt away.

I also filed a I129F for my wife as it was free. because i had a 130 pending , they didnt charge the usual $455 fee for 129F.

129 got approved and was sent to NVC on 16 April 2009. I got interview date at consulate for my wife on 7 Jun 2009.

But during the process of this 129, the 130 also got approved and the 130 is at NVC. I recieved a letter asking me to pay $70 AOS fee. I paid that fee.
Now what shall i do?. wait for next packet from NVC, to send the I-864? or send it now only. i have downloaded all forms and got them ready.


My dilemma is how do i cancel the 129 interview?. do i need to inform the consulate that iam waiting on 130?

Iam in no rush. i want my wife to come on Immigrant visa only. it will be better.

I also have a 4 month old daughter who was born in january 2009, one month before my naturalization, so she didnt acquire my citizenship at birth. i filed I130 for her too. but it is still pending.
I know i can apply for her citizenship once she comes to US,, but on what visa willl my daughter come to US. the I130 of my wife which is in processing at nvc, doesnt have the name of my daughter anywhere, becuase she was just born. what is the procedure for my daughter to be able to come to US and on what visa?.

Any help will be greatly appreciated.

You have already filed i-130 for your daughter. She will come to the states as an LPR and will automatically become USC when she enters that country. On the i-129F for your wife if it is too late to cancel the interview your wife should go to consulate and at interview tell them she no longer wants to pursue that petition because she has a i-130 pending and she is waiting on your child's i-130 to be approved.

wife's I130 is already at NVC, AOS fee is also paid. i will be having interview in about 2 months from now.

Daughters I130 is not approved only, its going to take a long time until it reaches NVC and consulate. My wife's and daughter's I 130's cannot produce an interview together at one time.
