I filed I-539 to change status from H1B to H4 due to a layoff within 60 day grace period (March end). I found a new job after 60 day grace period while the I-539 was pending. I-129 was filed with premium processing and approved May end (approved as change of status with future effective date of mid-June). The I-539 still shows pending (case received). I want to keep the H1B status without any interruption in employment. If we withdraw the I-539 application, my concern is what was my status between March end to May end. Also, since the H1B was approved as change of status wouldn't the H4 need to be approve for that time period?
What is the best way to proceed to process the I-539 appropriately?
1) Should we send an online request to USCIS explaining the latest situation and request I-539 approval until the I-129 start date?
2) Withdraw I-539 since I-129 was approved?
3) Travel abroad to abandon the pending I-539 application (have valid H1B stamp with 2+ years validity)?
