I-102 Information & Consideration of Deferred Childhood Action For Childhood Arrivals

Hello

My name is michael and am new to this Site.. !

Have been in the united states for 10yrs ..with an expired visa.. i recently got married to my GF..which is now my wife.. She decided to help me with my immigration status..we got a lawyer here in New York.. the lawyer told us that i have to first file for a I-102 form. which we did .. How long will it take for them to approve me !! I got a letter saying that my I-102 form was recvd on july 17 2012.. pls help..

Also , i was thinking i should also file for the Consideration of Deferred Action for Childhood Arrivals Process I-821D form .... i meet all the criteria for this form..

Should I file through marriage.. or through the I-821D ?? advice pls
 
I assume you're married to a US citizen, or to someone soon to become a US citizen, otherwise you have other bigger problems.

Do you still have the passport with the visa that you used to enter the US? Did they stamp your passport on arrival in the US? If you have that, you can go ahead apply without waiting for the I-102. The I-102 is unnecessary if you still have the passport+visa+arrival stamp, or the I-94 itself.

Did the lawyer file the other green card paperwork (particularly I-130 and I-485) along with the I-102, or is the lawyer waiting for the result of the I-102 before filing the green card papers?
