Husband not able to attend AOS interview

I apologize in advance if this has been discussed already. But I could really use some updated information which might help out a friend.

A friend has an upcoming AOS interview that her husband DEFIENTLY will not be able to attend because he was sentenced and is now currently serving time in jail. A family member of the husband will attend the interview along with the friend.


Even though it looks grim............ Any thoughts on this?
 
Not strictly true. There are cases where the AOS beneficiary can go to interview without the spouse, for example: the spouse being overseas on military duty. However I've never heard of a case where the spouse in in jail, so have no idea what would happen then.
 
Forgot to add PROBABLY or MOST LIKELY lol... That's odd, you don't hear about many people being locked up when it comes to AOS. I doubt people on this forum will be able to help. You should call Catholic Charities (u'll find their # on USCIS's website under field offices). They offer immigration advice over the phone and may be able to help.

Maybe you should go to prison, ask the prison officials to witness your husband writing a sworn statement in front of those officials, attesting that he loves you and seek to continue to sponsor you for this immigration benefits and that this marriage is a bona fide marriage, and doesn't seek to evade the immigration laws of the United States. After that, the prison offical can write a letter attesting their presence when he wrote this statement. :confused:

He should also write that he's sorry for this embarassment that he has caused to you, and you are fully behind him, except you didn't approve of his actions. He should also write that he's a PIG.... :rolleyes:

I am not an expert on criminal law, and neither seeks to be, but MAYBE this can help you case. I doubt if the presence of his family will help your case, other than his handwritten letter notarized by the prison officials. Moreover, he can maybe join in the interview via his one call per day allowance. :rolleyes:

Lastly, tell him to stop being a criminal. USCIS might want to evaluate your own character based on his crimes. U probably heard the saying, bad company corrupts good character. So, you might want to invest in a criminal background on your husband while he still in jail, unless you know his past, maybe there are more surprised... :eek:

Actually, the family member won't be able to attend since that person is not the petitioner. And those are the only ones that should be on the interview and are asked to be there.

I just heard about one case and was on the news like three years ago but I did remember even the scene when this guy was getting on the police car. That the police was able to work with USCIS (INS at that time I think) and catch people with pending warrants. So the sponsor/petitioner had to get their warrants taking care of first and then work on their immigration cases. In the news was the case of this guy that get caught I don't know why, but he had to serve several months first before finish the immigration issues of his spouse.
