Husband filed for H1, i m on F2... planning to travel to India?????

Ginnu, others Help!!!!!!!!!!!!!!

Hi everyone,
Plz help me with this ... My husband has filed for his H1-b.. currently on OPT n myself on F2. But i m planning to visit my parents in India but i have so many questions...
1) Can i apply for H4 along with my husband H1 application, wat r the charges and when will we get the stamped receipt of approval?
2) IF i travel to India while my H4 petition is still in processing, can i re-enter US on my F2?
3) In case i go to India with my current visa status, will i have to get my status changed in India, n if yes, are there ne chances of my application being accepted or rejected?
4)Will i have to go through the interview all over again?
5) My son was born here in US on Jan 1st 2004, so can my application be rejected or approved considering this point?
Please help!!!!

------Actually you should have aplied for COS with ur husband as the day ur husbands H1 is approved u will be out of status.

------You cannot leave the country while COS is pening as that means abandoning the petition. You will have to wait till COS is approved.

----- You will need ur husbands approved H1 (notice of approval ) for you to get H4. The chances of rejection or acceptance depend totally on your circumstances and the will of the visa officer

4)Will i have to go through the interview all over again? ------Since this a is a new kind of visa and in any case the drop box is discontinued so you will have be interviewed

5) My son was born here in US on Jan 1st 2004, so can my application be rejected or approved considering this point? ---NOPE----

One more thing even after approval of COS in case you do it here, next time you travel out of country you will have to get a visa stamped (H4).
