I had stated in an earlier post that my husband has already got his labor approved and we r applying for concurrent processing ( I-140/485) using that labor- it shd be filed within this week.
Based on the labor pending more than a year my husband has also gotten a 7th year H1b extension till Jan end 2005. Meanwhile my labor shd be approved soon too ( in a month or so according to my lawyer) , and the catch is I work for a bigger company which is paying my GC costs, whereas my husband has to pay for everything himself. If I apply for concurrent 140 and 485 based on my labor and at that point withdraw his application , (so that my company can pay for everything ), will he still be able to extend his H1b next year for I -140 pending ?Or is this risky and we shd just continue with his application and just forget about mine.
