Hubby filed for H1, i m on F2... planning to travel to India?????

Hi everyone,
Plz help me with this ... My husband has filed for his H1-b.. currently on OPT n myself on F2. But i m planning to visit my parents in India but i have so many questions...
1) Can i apply for H4 along with my husband H1 application, wat r the charges and when will we get the stamped receipt of approval?
2) IF i travel to India while my H4 petition is still in processing, can i re-enter US on my F2?
3) In case i go to Inida with my current visa status, will i have to get my status changed in India, n if yes, are there ne chances of my application being accepted rejected?
4)Will i have to go through the interview all over again?
5) My son was born here on Jan 1st 2004, so can my application be rejected or approved considering this point?

Filing for H4 is very simple. I am not able to understand whether your husband already got H1-B stamped on his passport. I assumed he has his visa stamped on passport.

You can apply for H4 very easily from India. There a set of documents required for H4.
1. Letter from Employer of your husband that he is still working.
2. His LCA forms (if asked)
3. His paystubs.
4. Affidavit of support.
5. I think there are 2-3 USCIS forms that you will get when you go to Consulate.
6. Proof that you maintained legal status at all times.
7. Marriage certificate
8. Marriage pictures and if possible marriage invitation cards.

The procedure is very simple. Check out with your husband's lawyer or contact the consultate.

Remember, drop-ins have stopped in india.
