howto H1B Visa Help!

After a very long time I again returned in this forum. Well, I want to come USA on H1B visa. An employer/sponsor can file a petition for me so bring me in USA. I need some help from well renowned lawyers here in this forum.

Where can I find H1B employer/sponsor and their job list/offering? I tried google but all seemed to be fraud or paid service like h1base.com and many others. Some people advised me to search for jobs at dice.com and monster.com but I can't see any job mentioning H1B or something like that like non-US employee can apply etc etc. So can anybody help me to find out some sponsors or advise me some idea on how to grab those job opening?

Does the H1B quotas for this year 2010 replenished or still available some visas? I heard that due to economical recession companies are hiring slowly or not at all, so unlike previous year, this year's visa number is still available. is that true? Do I still have the time to apply at any employer and if lucky can join the company by 1st October 2010?

There is a premium processing available at USCIS, is it reliable really or some money making plan of US govt.?

Some researches complain that H1B employees get lower than average salary than a US citizen/permanent resident/green car holder, if it is true then is there anyway to avoid this racism like harassment ?

I haven't mention about myself. I am a recent graduate on Computer Engineering from a very reputed private university in Bangladesh, the university has collaboration some of the very topmost US university for education managements. I have a CGPA of 3.00 out of 4.00. Also hold some certificate and/or training on some very demanded IT track like CCNA, CCNA Security, Sun Solaris Administration, Red Hat, Oracle, Microsoft System Administration. My interest lies on IT administration, consultation and management specially at Networking and Security. I don't know how is my chance at this economical period in USA for a H1B visa. Some says it is very poor chance and some says I have a very good chance statewise in DC, California - silicon valley or New york.

So hope you understand my situation and I hope I will get some very useful and helpful reply to proceed with my life. More questions may rise after discussion and reply.

If you think it is a good idea to proceed taking help from lawyer, then I am ready to go and can pay.

If you are already mentioning "racism" and "harassment", you need to rethink your plan of coming to the US. You will likely not be happy. Your entire posting indicates you have unrealistic expectations of the opportunities available in the US during this time of extremely high unemployment. Legitimate employers do not differentiate pay based on visa status. People desperate for any type of work in the US are willing to work for disreputable organizations for wages that have driven down all IT wages. Entry level H-1B pay is very often less than that of others with US experience in similar positions. You will be on the very low end of the salary scale; this will not go far in high cost of living areas.

GPA of 3.0/4.0 in the US is not exceptional. At the university I know best, you would not be admitted into an MS program.

CCNA and most of the others mentioned are not a particularly unique certifications anymore. Many non college graduates possess these and these alone do not qualify for H1B. If you are exceptional at networking and or security, you would likely have a CCIE in one or both of those. You seem to be overly impressed with your credentials. You are a recent graduate with little practical work experience. There are tens of thousands of people like yourself - a large number of which are recent graduates of US colleges and even US citizens - looks for jobs in IT. You are certainly not qualified for a management, consulting or administrative position. You are qualified for an entry level position only. Do not falsify your credentials; if fake experience is detected, you can be permanently banned from any kind of entry to the US; some disreputable employers will ask you to do this in order to place you and obtain the needed client documents.

A lawyer cannot benefit you as the petition for you must be filed by the employer.

Paying for an H1B visa is illegal; there are a very limited number of fees that can be paid by the prospective employee. Be very careful if you are asked for payments.

Actually as I am not living in USA, so have no idea about its present situation, all information I get from online news or from some relatives living there.

You said, with CGPA 3.0/4.0 I have no good chance for a MS program in USA, but with a GMAT score of 730 and GRE score of 1520? Do I have that possibilities?

As per requirement of experiences, I have experience working at HSBC IT dept for 6 months and also servicing some insurances and banks for the last 1 years. I am a freelance technician and software developer. Currently I develop applications for facebook and iphone. Very soon will move towards Android too. Did some web developments at rentacoder.com and getacoder.com. Also did an application development for country's largest telecom company Grameenphone and also measured security facilities over there, actually took the chance while doing the app development. I am also a member of Asia-Pacific Cisco CCNA 2009 competition's 1st runner's up team. I will start my CCNP and CCSP preparation from August.

And for myself being overly impressed with my credentials is not a factor, the thing is what I know and how well I know. You know USA is a land of opportunities and for this reason people wants to come here, so am I. non-immigrants or immigrants are not only coming here for their own economical benefits but they are contributing a huge at US economical situation.
 
IMO, you should find a good employer in your native country, get the required experience and come on an L-1B visa. You are less likely to be taken advantage of by disreputable consultants who prey on people like yourself. This does not prevent you from finding an H1B employer in the future. Your stated experience is entry level and there are tens of thousands of people like yourself looking for jobs at this time. You will be competing with advanced degree holders educated in the US for the same positions.

Working on CCNP and CCSP certifications is fine, but will not get you a job. You need to understand the tech schools offer CCNA classes to high school students in my area. I hear reports of even CCIEs being unable to pass interviews at some employers; the consulting firms want to pay very low for even CCIEs with ten plus years of experience; they were paying the rate I earned as a contract programmer over 15 years ago. All is not well in the US for IT professionals.

Your test scores may or may not make a big difference. While standardized test are important, the falsification of scores abroad is an issue. GPA indicates motivation and is often seen as a better indicator of future academic success. It is quite likely that you would not make it past the first screening of applicants with your GPA at many schools; others with different selection criteria may be impressed with your scores. You would be better off if you have the finances to pursue graduate study in the US prior to seeking a guest worker visa.

I am speaking from a great deal of experience; my immediate family has a dozen technical degrees (I don't even count those in law and business) and over 130 man years in IT and related areas as well as technical education.

Others - especially guest workers with the consultancy firms - will have a different view. But, no matter what you decide to do, you must become familiar with the rules governing the H-1B program. You must be suspicious of unknown consulting firms.

These are the very fundamental steps involved. The biggest challenge is to find a good employer and validate their details before you join. Follow the timeline suggested for filing visa petition. Make sure you know someone in the management level in the company you plan to join. You will need their full support for H1B visa stamping and your future growth in the company including green card and other benefits. Do NOT be fooled by people who try to refer you to a consulting company just for the sake of $1000 or $1500 bonus. No one says it openly; you have to trust the person who refers the company and give honest opinion about the company. Do NOT join a company get H1B sponsorship from them because someone in online communities like Orkut, Facebook or in any FORUM suggested a consulting company. Take recommendations from people you only know or through proper referral. It will be hard to recover the monetary loss or switch employers quickly once you get H1B approved and you end up coming to US through that company. You will have to stick to them for at least 3 to 6 months or more who knows ! Be careful and make a wise choice !
