My son came to usa on H4 on 08/23/2009. He has passed 11th grade and going to 12th grade from sept 2012.
He is now 17 years old.
My H1B 6th years are about to complete in November 2012. So my son's H4 status will also be expiring on November 2012.
After Nov. 2012 he will not be having valid status.
As per Obama's dream Act
"Under the order, individuals need to be at least sixteen years old and no older than thirty to be eligible for the deferred action policy. They need to have been brought to the United States before they turned sixteen and need to have resided in the country for at least five continuous years before their application. They also need to be currently in school, or to have graduated from high school or gotten a G.E.D., or have been honorably discharged from the military."
Questions:
Q1: How should he continue his 12th grade study after Nov. 2012.
Q2: Will public school issue Student visa ?
Q3: Will he be benefited of Obama's Dear Act?
Q4: Can I get student visa(F1) from college as I am about to complete 6th year on my H1B?
