how to make up for your past IRS sins?

Hi,

I'm sure lot of people out there who works in the consulting companies will have this question in their mind. So here is my story.

In year 2002 i was paid only for 4 months. In that year, the consulting company who hold my H1 visa didn't have any work for me. So NO WORK NO PAY. After that since 2003 I’ve never been out of work and they have been paying me continuously according to LCA. I know that what happened in year 2002 was illegal or wrong because I needed to get paid as long as I was in usa on H1 visa. Now I’m thinking about applying for green card & also stamping visa in usa consulate in India for visa revalidation etc. I’ve read on chennai consulate website that they ask for all the years w2 forms. Also things are becoming very strict these days and this question may be raised even when I file my green card petition. Is there any way I can solve this issue in advance? CAN MY EMPLOYER PAY ME MY YEAR 2002 SALARY NOW? AND CAN I FILE MY INCOME TAX RETURN WITH IRS AGAIN FOR YEAR 2002? (My employer needs me & he is ready to help me out however he can)

i guess u can revise u r old tax return by filling amandment form and show higher income raised by fillup a 1099 form. ofcourse u have to pay some more tax as u r filing it little late. (usualy 12% to 20% higher tax then normal)

check with u r Accountant and file and amandment for the year u have show less income. this will benifit u r employer also as u r showing 1099 he can throw it in expense if he want else its fine.

MAY BE u r account then print u a new revised taxreturn combined both. or just revised is fine.

Its kinda expensive way but if it helps then who cares. right?
