I came from Trinidad & Tobago on a holiday Visa in 1997. I have overstayed and did all my schooling here in the U.S with great grades and have just completed my 1st yr of college in Tx and is 19yrs old. I am currently a student in a Christian University. I am able to pay all my school fees with help of my father that lives in T&T. I currently want to apply for an F-1 visa but do not know how to go about it or if I would be able to since i have overstayed and is living in the U.S.

Any advice will be greatly appreciated :)

You cannot obtain a student visa. You are illegally present and subject to possible detention (jail) and deportation.

Go home and start service your 10 year ban from entering the US in the future. Leaving on your own accord will be much less painful in the long term than having immigration proceedings find for your removal.

Thank whoever brought you here but not taking your home for making you a criminal.

Does your school know you are illegal? I'm sure they would not approve.

You need to consult with an immigration lawyer NOW! Don't listen to a few of our opinion who just tells you to leave and face whatever 10 year ban they subjectively think you deserve. Go see an immigration lawyer. This could be fixed, but you are likely going to have to fight it in Immigration Court. Only a lawyer can give you competent advice. Not me, and certainly, not the one poster above me.

Please leave your subjective opinion out of this. Her case requires legal advice that YOU cannot provide. Telling her to leave and face the ban is IRRESPONSIBLE! And whatever her DSO might think is also none of your business. Finally, be advised that Immigration Proceeding is considered CIVIL in nature, not criminal, as decided by the US Supreme Court. Don't post bad advice if you have no clue what you are talking about.
