How to file amendment from COS H1 to Consular H1

Hello,

I am on L1b Visa in US thru employer A. I did apply for H1B COS (Apr 1st 2008) thru employer B. I am selected in Lottery and now awaiting I-797 for H1B. Seeing current market scenario and my wife on L2 (looking for job) I do not want to switch on H1B immediately. Is there any way I can be on L1 only for some more time after 1st Oct 2008?

I have heard that there is an amendment can be filed to change from COS H1 to Consular H1. Please throw some light -

1. when to apply for this amendment?
2. How much money it costs?
3. Who will file for amendment? (me or Employer B?)
4. Then when can I shift on H1B after amendment is done?

Please reply to this post as this is the time I have to take some decision.

Under the current situation you will be on H-1 from October 1, 2008. If you file an amendment so that your application changes from COS to Consular, then you can keep your L-1 status as long as your current visa is valid. When you want to switch to H-1, please travel abroad to get the visa stamped at an US consulate. I do not know the details about amending a H-1, but this has to be done by your employer.
