How to Correct the H1 7th Year Extension Error

Hello my fellow H1 friends, please help me!

My 6-year H1 was expired in Novemver 2005. Before the expiration my attorney filed the 7th year extension petition for me in July. My labor certification was filed in Oct 2003, and now it's pending in Dallas. Instead of getting a full year extension, the USCIS extended my petition only to Jan 2006. I don't know what's the reason why they extended it for only a couple of more months.

My attorney said we probably filed the extension petition too early, is that true? I thought we are supposed to file the petition a few months earlier before the expiration date. So I assume this could be an error at USCIS? If that's the case, what is the best way to request for correction? My attorney has been in email contact with USCIS, but it nerver helped. Now my attorney wants me to refile the petition, but I don't know what would be the best way in this case.

Please help if you have any suggestions, or any similar experience in this case.

Assuming your attorney didn't provided the correct start and end date. I would suggest you to look at your H1B paperwork submitted for ext.

May be your attorney trying to rip your pocket by filing multiple times.
