Its tough to understand the priority dates concept. Let me give u an example which is one of my friend's case...
1. He filed his Labor on Jan 2003 & state labor cleared on aug 2003.
2. In Aug 2003 it moved to federal labor & in March 2005 moved to BACKLOG center.
If the labor cleared from backlog then he will be filing for I-140 & I-485. But the I-485 date shows March 2004 & for I-40 is Jan 2005.
Question: can he file I-40 & I-485 now if labor is cleared from backlog?
I appreciate if someone can clear my question?
