How to apply for EAD

Hi! Please answer this question. If I apply for EAD, do I must apply for EAD for my wife and son, or just put their name on? Thanks. ic

Every applicant that needs an EAD would have to submit separate applications (I765).

You can't "add" someone else's name to your EAD application.

Also, your applying for an EAD doesn't force your wife/son to apply for one (and vice-versa).
They can do it when they want it (or rather if they want it !! )
 
Hi..Im just waiting for my LABOR CERTIFICATION to get certified after that i can apply for EAD and AP.Sorry for the basic questions i really want to know i dont have a clue.

Just wanna ask you how did u FIRST apply for EAD and AP?
What is the requirements?
What office do i go to INS - Application Support Center (ASC)?
What forms do i need to fill up?
Can you guide me thru this im so clueless. Thanks I appreciate it!

Your dependents will be in 485/AOS pending status -- and they will remain in that status till a decision is made on the 485
(am assuming they don't have H1 or H4 status)

That's legal status to stay here .... you need EAD only to work.

Many many thanks max2k. My wife and son 's H4 will expire in Jan'05. Don't I need to apply for a visa type of status for them when I apply for EAD? ic

If you are going to keep your H1 status (which is the better option esp if your 140 is still pending (or) your 485 is pending <180 days), might as well extend their H4 status as well.

But if you are not going to be in H1 status after Jan '05 (say you start working on EAD), then your dependents automatically fall back to AOS pending status.
(Heh heh -- assuming their 485 is filed before the expiry of H4 status !! )

When you want to apply for EAD later, copies of 485 receipt would prove their present legal status.

max2k1: thanks a million from the bottom of my heart. I have 140 approved and 485 pending for almost two years. I am thinking to have one EAD as backup in case the H1 extension have any problem. ic

What do you mean by "<180 days"? Can't you start using EAD the moment it cmes in? Please explain.

You can .... but using EAD means that your H1 status is gone.

Its advisable to use it after 140 is approved and 485 pending >180 days (to use AC21)
( In the case you lose your job ).

Its only a safety precaution - not a rule
