How to account for period without I-94

Hi Everyone,

I travelled out of US to get new I-94 for the present employer's H1 and I did not work for two weeks from the physical receipt of the approval notice.

Now the question is : How to account for this period ?

Any suggestion / advice from seniors / attorneys will be highly appreciated.

Since you said, you had to travel out of US for getting the I-94,
then you would have got your H1 Notice of Approval with Consular approval.

Now it looks like you have already got the VISA also in your
passport.

You do not have to account for this brief period. I hope you have
started working for your new employer.

Raju,

Yes. I got the I-797 with consular approval. I got previous visa stamp valid till latter half of 2003.I did not get the visa stamp for the new I-797. I have been working for this employer since the date of receipt of the new H1 petition.

I got the new I-94 and also re-started work.

But my employer is thinking of showing this as leave without pay or some kind of that thing. His argument is that taking leave for that period will not be valid as one is not supposed to work for the employer when one does not have the I-94.

I do not know how to convince him that I can put leave for that period.
