How soon to enter US

My interview is in November. I am planning to Spend another 7 weeks in India on a vacation, and plan to come back on Jan-12-2004.

Do you guys think it would be a problem at the POE ?. Please suggest any precautions.

You will be given 6 months to enter the US as a new immigrant.
You will have till May 2004 to enter.

Thanks you for a prompt reply.
My concern is if at the POE, would I be asked questions, and required to prove that my employment is still valid. I may not have anything to prove that my employment is still valid, except that they can contact my employer, if I retrun on a working day.

What are your thoughts ?.

does anybody else have similar situation ?.

As Raju said - no problem at all. Your immigrant visa is valid for 6 months. Only stipulation is that any dependents on your application can only enter WITH or AFTER you make your initial entry as an immigrant.

Just have your employer send you a letter confirming that you are still employed. Have an original letter sent to you (eg. by Fedex or DHL). That should more than take care of any concerns the immigration officer may have. More than likely, you will not face any such questions at POE but never hurts to be safe.

I have not come across any posts where the questions were
difficult at the Port of Entry.

However it would definitely look strange if the main applicant
spends too long a period ( say 4 to 5 months) before entering
US. This can give raise to question about validity of the
employment.

Since you said the period is going to be only 7 weeks I did not
deem it necessary to write this earlier. However , as suggested above, just to have some peace of mind, carry a letter from your employer dated close to your travel date, confirming the availability of job.

Even this may not be asked at PoE!

If you are going to be paid during this vacation period, and
if you can download the bank statements, that would be proof
of your continued employment.

But all this may not be necessary!

Thank you Zaye, Raju for your suggestions.

Yes. I will be paid during the whole period and I have discussed this with my employer. They suggested that I can carry a letter from my supervisor, denoting that I will be on vacation for a toal of 8 weeks(1 before and 7 after CP) , thus effectively utilizing my CP trip (and travel costs).

But they will issue the 'vacation confirmation letter' right now along with my employment verification letter.

Don't you guys thinks that'ld be enogh, even in the worst case scenario.

well my 2 cents:

I honestly dont think vacation confirmation will solve the purpose incase of questions at POE.

In the current situation, all the companies may be happy to issue vacation confirmations,however, the big question is, how many of them will be willing to take back the employee AFTER they return from vacation?

Hence, as suggested by others, I would say get an employment letter dated say a week before your scheduled arrival date in the US.

And all the more good if you can enter the US on a working day during working hours,incase the officer at the POE wants to make some phone calls.

I don't intend to discourage you, but just putting my thoughts.

Better to be safe from all sides.
 
I have checked cptracker and noticed that there are instances of EB cases, where the Date of Entry is few months after the interview date. As a result of this, Along with the posts from Raju and Zaye, I am not much concerned about it now. Thanks guys.
