How officials handle requests for emergency advance parole

Emergency requests for advance paroles are processed on a case-by-case basis, based on the nature of the emergency, and must be accompanied by enough evidence to support the request.

If your I-485 application is pending at a Service Center, you must file your application for advance parole at the same Service Center. You should not make any travel plans or purchase tickets until you receive your travel document.

In cases involving illness, we will consider applications for the applicant's immediate family only. An immediate family member is defined as a parent, spouse, child, brother or sister. The application must be accompanied by a letter from the doctor providing treatment and must include the diagnosis and the prognosis to fairly evaluate the merit of the request.

In cases involving travel related to employment, we will consider requests for expeditious processing of the principal beneficiary's application only. The application must be accompanied by evidence that the applicant is the only person who can perform the duty abroad and/or the company will suffer substantial loss of revenue if the application is denied.

Any document submitted in a foreign language must be accompanied by an English translation of that document. The translation must be signed by the translator stating that he/she is fluent in both English and the second language.

If you can provide the A-Number we will be able to more quickly locate your file to verify your eligibility. If you cannot provide an A-Number you must provide the exact date of filing and your name as it appears on your I-485 application.

If you provide enough evidence to justify issuing the travel document in an expedited manner, we will try to issue the advance parole to the applicant before their travel date.

If expedited processing is not granted or if the application is ultimately denied, the filing fee is not refundable.

Once you decide that you need an emergency advance parole, you must go to the USCIS office nearest you. It is best that you visit the USCIS with the listed documents first thing in the morning.
