All our advertisement has an education requirement as follows
"Bachelors degree in civil engineering with concentration in Geotechnical Engineering (Master of science preferred)". With this advertisement
Can I choose Master’s degree for the minimum education level required (Part 4, Section H in 9089) with an alternate field of study as Bachelers with 2 years experience? Would this education qualify for EB2?

Thank you

Your actual minimum job reqt is BS. It is not MS, since it is "preferred" but not "required".

BS+2 = SVP Level 7 = 2+ 2 = 4 yrs of preparation
MS+0 is also SVP Level 7 = 2+2 = 4 yrs of preparation
So the abov etwo minimum job requirements are "substantially equivalent" as per the PERM regulation since they are in the same SVP Level as determined by O*NET.

Alternate requirements can lead to outright denial due to Kellogg's case if you qualify by means of alternative job requirements and not by means of primary job requirements (if you don't state on the box H-14 that "any suitable combination of education, training or experience is accepatble."). Do some research before having alternate minimum requirements. It is best to be sponsored for a job that has only primary requirements and no alternative requirements to avoid Kellogg's denial.

Good luck!!!
