I have a very specific question.
I am in the USA on an H1B.
We applied for a B1 visa for a domestic helper from our home country. This was approved. Her visa is annotated with "Domestic helper of H1B (my name)".
She entered the USA in March of 2010. She was given 6 months stay.
Upon entry, we immediately applied for Employment Authorization Document. This was approved, and the expiration date for the EAD is March 2010.
Before her 6 month stay expired, we applied for a 6-month extension. This was approved, so now she is legally here until March 2009.
We want to apply for another extension, just for another 3 months.
1. Legally, CAN we apply for another extension?
2. If it is eventually denied, and the denial comes AFTER her current stay expires, would she be considered "out of status" starting from the day that her current stay expired?
