How many labor applications are pouring in every year

The current system that they have put in place is feeding the problem. They have expedited the labor process and the 140 approvals but the visa numbers have not been changed in ages. Earlier it took a good 1-2 years for a person to reach the 485 stage (6 months to a year for labor and the same for 140). This delay in processing actually helped the system because it acted as a buffer for the limited visa numbers that are available. Now people who have current PDs are reaching the 485 stage within 6-8 months and utilizing visas at ever growing speeds. People who are from retrogressed countries and who went through the old system and have been waiting for years for their labor, 140 and 485 are plain screwed.

The whole speeding up of processing was done on the order of the White House that wanted 6 month processing times by 2006. They achieved that goal by putting together this half baked plan that screws over thousands of cases that have been pending for several years. Add to that the problem caused by 245i's and labor subs and you truly have the perfect storm.

Anyway, whats done is done. We need to move ahead without the GC. It will come when it has to.

I always wonder why you have not joined the bandwagon to change from EB3 to Eb2~~!!!

Whats going on friend? You could also ride the fast labor/140 approval and have PD current!!!

Please advise all of us

Being an August 01 PD holder I was waiting to see if something would change in the near term. It is now certain that things will not change for a while and I will seriously give it a thought. Honestly, I am not convinced on the feasibility of EB3 to EB2 and have not researched it. Another thing is that my EB3 process had been very rough at every step. Lost apps, wrong transfers, name check issues, RFEs. It took a lot of effort to get the case back on track.cStarting the whole thing from scratch honestly scares me :) :)

I guess the next logical step is to consider the switch from Eb3 to EB2 especially if this current CIR fails.

Did they transfer your 485 to TSC?

I heard most of the pending and retrogessed 485 cases were transferred from VSC to TSC.

Do you have any insight on why few cases were not transferred?

The current transfer of apps between service centers is due to the Bi-specilization efforts of the USCIS. Only NSC and TSC are supposed to process 485 cases and every 485 pending in VSC and CSC is being transferred from them.

The problem with transfers is that they are not reliable. The USCIS is a very careless organization and invariably there are wrong transfers or apps are left behind. With so many changes taking place in the process it is hard to tell when something is a mistake and when something has been done on purpose.

In my case the app was transferred by mistake from TSC to a local office in Miami. This was in 2004. By middle of 2005 I was able to get the app back in TSC. That was purely a USCIS mistake. I don't think the current transfers are mistakes but there will be mistakes. Its upto the applicant to ensure that his/her case is in the right place.
