How long will it take to bring my Fiancee to USA?

Hello guys,


I applied for my I-485 in July 2000 and since then waiting for my green card. Looking at the timeline I will not my approval until 2006. My fiancee is living in HK. Recently I tried for her tourist visa but unfortunately it was denied.

Well now if i go to HK and get married, is it by any means possible to apply for her so that she can come here permanently?What is the procedure? When can i be eligible to apply for her?

These question might have raised by others before, since I am new to this forum, any help will be greatly appreciated.

I wish I have better answer than that but this is a very hard case. If you marry her she will need to wait until you get your green card and then she will have to wait another 5 years after you apply for her . We are talking about a total of 8 years here. The only way for her is to keep trying to get a visa and when she comes here she can apply for asylum. Or, if she is a skilled professional you may want to find a company that can sponsor her ( even though the economy sucks these day. Another solution is for her to apply for immigration in Canada and she would then get a Canadian green card and can easily come to the USA ( easier to get the Visa with a canadian green card). I think now there is a "V" visa category in which one can bring his or her spouse to USA if once application is pending for three years or more.

Is this not applicable for asylees? I think it should....

This V visa is hard to get and it only applies for spouses of green card holders. For more information, read this petition concerning the restrictions of V visa [ am writing to urge you to help eliminate the five plus years waiting period for immigration of the spouse of green card holders. The present delay separates families. It is against all principles upon which this great country is based.

Under the present system of immigration, it takes approximately six years for the spouse of a U.S. Lawful Permanent Resident (Green Card holder) to receive immigration to USA. Congress had, in the interest of family unification, taken an interim measure (V Visa) to provide some relief. But that relief suffers from two grave defects. One, it mandates a separation of three years before the families can be reunited. Two, it is available only to those people whose applications were pending on or before December 21, 2000.

Currently, there is one Bill pending that provides further relief to our community. Honorable Representative Robert Andrews had introduced H.R. 539 to provide for the family reunification by removing numerical limitations on admission currently causing the delays. H.R. 539 embodies the sacredness of family unity revered in the United States of America. Please help support this Bill or a similar ameliorative measure. Our community stands behind this effort.

What if the GC holer's spouse is already in the US on stuent visa? Let's say they got married after the husband receive his GC, how long woul it take for the spouse to get her I-485 approved? And while her I-485 is pending can she apply for EAD?

I think she will have to wait the same period for her i-485 to be processed ( 5 years). The petition that i posted in my previous post clearly indicates that getting the V visa is almost impossible. It was put by these bozos in Congress to make them look as if they did something. As a metter of fact they are as devious as always and it would have been better if they did nothing. I think the best way is for her to keep her student visa by any means such as graduate school or something. Wish i have better solutions
