how long we should be residing in dallas to get eligible for dora

hi guys my name is vishu, i came on f1 2001 fall, i got out of status due to some problems. i got married to usc in oklahoma in 2003 may seperated in jan 2004.i came to texas i met a girl since 2004 november living together from april 2005.do i have to take divorce at any cost or is it ok.i dont want to face that crazy girl again its 2 years since we got married ,she could be just fine or she could be trouble.how long do i have to be a resident of dallas before i am eligible for dora,i am signing lease this april 22 on wards i am a pharmacist & have cleared my fpgee i am on my wayto get my licence r there any good lawyers who can directly get me to h1 if possible ,how should i plan myfuture guys give me some advice thank you

Vishu,

1. Did you file any papers through your first wife? If not, you are out of status and getting H1 will be very difficult (quiet frankly impossible) for you.
2. If you are planning to marry your new girlfriend, it is a law that you divorce your first wife before you do that or you can end up in jail and face various lawsuits from your "not so pleasant" wife.
3. You can file for DORA as long as you live in Dallas service center dictrict...no time limit.

My best advice to you is to get a good divorce lawyer and get divorced first. Then get married to this girl and apply for adjustment of status. If you file through DORA, you cannot apply for your work permit (unless they dont process your GC within 70 days). Another option for you is to mail in your papers which may take 2 years but you can get work permit right away.

I have listed a few options...the choice is yours.
