How long TSC will keep me waiting?

It is more than 4 months since I responded to the RFE on my EB1EA self filed petition. TSC has not yet made a decision. They had not sent me any written update after I placed a service request a month back. Whenever I call TSC or the customer service, I am told about background check or other irrelevant things. I know that I-140 has nothing to do with bacground or criminal check. Has anybody in the forum experienced a delay of not getting a decision after submitting RFE?

Many people are getting decisions within a month or two after responding to the RFE. I just dont understand why this much of delay is happening in my case.

My EAD is going to expire in 3 months and have to apply for renewal. I want to know whether my I-140 is approved before I apply for EAD renewal (I-765 filing fee is very high you know).

Can forum members suggest have any suggestions?

There are background checks associated with I140s... They are not secuirty checks though or name checks. In most of the time, these background checks are associated with the verifiability of the paper work submitted.

I read somewhere that now on (fee increase, 30th July) one should not have to pay for EAD fees anymore, just the first time, that you already did. Please check that and let us all know about it.

You meant to say that they check all RECO letters submitted - call the referees or check the publications online....etc.....

Are you sure is this to all EB1-EA guys or it is done on a random basis.
 
On the EAD filing fee...
Indeed the new I-485 fee includes EAD and APD. But refiling for an expired EAD for an I-485 filed before the fee change (or using the old fee) means paying the bill ($340).

Adjustment applications and ancillary benefits – The new application fee for an I-485 is a package fee that includes associated EAD and advance parole applications. Thus, if you file an I-485 with the fee listed above, while you will still need to submit applications for an EAD and advance parole, you will not need to pay a separate fee so long as your adjustment application is pending. However, if you filed your I-485 before this fee change, to apply for or renew your EAD or advance parole, you must file a new application with the new fee for those applications.
 
to be sure, the sentence "you will not need to pay a separate fee so long as your adjustment application is pending" means that we'll never need to pay for renewals until we receive the green card?

None of the people that gave recommendation letters were contacted. I just dont know what is going on.

Congratulations. Did you get the approval email today? So they took more than 7 months time to approve your case after you responded to the RFE. Great. Now I know that I am not the only one in the boat. You were there silent all along. Good luck with your 485.

What USCIS is saying is you have no advantage if you were early filers as you will anyway end up payinf ~ 650 dollars for EAD (D-340) and AP(D-305) renewal whereas the new filers don't!!!!

So basically people who thought they are saving bunch of money by filing early may end up paying more in the long RUN.....!!!!:confused:

Has anybody who filed the EAD under the new fees gotten their card yet? My guess is that it's valid for a multi-year period, not one year, which is why you only pay the fee once...it should (theoretically) last until one gets the green card..
