How long for FOIPA response

I have sent in a request for a FOIPA for myself and my wife to the FBI. I know they received it on 3rd Jan, as I sent it via certified mail.

For those of you who have already done this, how long did it take you to receive the response from FBI after you sent in the request?

Thanks,

I have always heard of it, what exactly it is and how is it done and does it really work? Please advice.

When you submit the I-485 application, USCIS will send your biographical information to the FBI so that the FBI can check your background and certify that you're not a criminal and/or terrorist.

Recently, this is turning out to be a big mess as it's taking years for these checks to clear (for some people, not all). So you might get lucky and finish your namecheck in 2-3 days and your best friend could get stuck for up to 4 yrs.

So even if your PD is current you might have to wait a few years before your namecheck is cleared as without the namecheck the USCIS will not approve your 485 application.

My pd is not current. Can I still call them to find out if I am stuck in namecheck? Will they tell me?
Can I still request FOIPA?

Don't call them. It'll do you no good. And they won't tell you anything.

Also they send your namecheck to FBI (and a couple of other agencies) once you file your I-485 so there's nothing much you can do about it for now.

Just hope that when you do file your I-485 your application won't get stuck in namecheck.

I sent this around 1st week January and still to hear from them.
Someone posted on Yahoo namecheck group that it takes about a month.

By the Way, there seems to be some activity by USCIS to remove WOM as a condition to expedite namecheck. This would close the last door on getting any result out from USCIS.

No No U got me wrong, 485 is pending more than 2 years, held in retro...
So can I request FOPIA? Please help....

FOIPA has nothing to do with your namecheck or 485.

The help it provides is in approaching your congressman/senator, you can add this document. It also adds to the due dliegence wrok proved by you to Court in getting your name check clear.

Search for FOIPA on googleand you can find more.

Sorry!

FOIPA has nothing to with immigration or USCIS.

It's a law that allows anyone to send a request to the FBI so that they can find out if the FBI has any sort of record on them. (sort of you running your own namecheck on yourself with the FBI).

So there are no conditions on sending a FOIPA request. Anyone can do that.

Yes, go ahead and send in a FOIPA request. Just google for it. Or just search within these forums and you'll find plenty of info.

Thanks a ton.
You have written that you got a letter in Oct 2006 from VSC saying namecheck stuck, did they send it on themselves or did you call to get that specific info about namecheck or general case status?

I bugged my attorney about it and he called up USCIS for the case status.

They then sent me a letter giving me the, er, good news.

To answer my own question, my FOIPA was responded to in about 3 weeks.

If you're sending your own, use the PDF link above.
