How long does it take for INS to ask for Employment Verfication Letter?

:confused: My I-140 was approved last October. However, my company has suspended the I-485 submission saying my salary is 5% lower than the prevailing wage. So I need to know how long it will take for INS to ask for Employment Verification Letter right after I find a lawyer to file I-845 on my own? I think I can get that amount of salary in Feb or June of next year, i.e., 2004. Thank you!

I do not see why you should not file right away as
The current processing time is approx more than one year
and by the time the case is decieded you should be in the
range of the specified in the LCA. Also remember as the GC is
for a future post The employer has to only state that you will
be given that salary when you have the Green Card
 
The company I am with is not even willing to issue a letter of any kind to INS with my I-485 application.

So I only have one route to take. That's to file the I-485 on my own without any supporting letter from the company, and then hope INS will not consider this as a case of incomplete documentations, so they will request for the Employment Verification Letter at the RFD stage, when my salary already meets the amount on LC.

BCIS/INS can request for Employment verification anytime before they make a decision on the case.
