CP gurus, Please advise!
My I-140 EB2, is ready for filing at Nebraska. I am opting for consular processing in Sydney. I can\'t go there till June due to work commitments (I am a Prof. at a Uni). It takes about 2 months (I think at NEB for I-140). Should I ask my attorney to delay filing I-140 or should I go ahead with I-140, and then delay sending Packet 3 or delay consular interview by some other means? I would really appreciate some advice.
thanks to all

Applying for I140 now

By March/Apr I140 may be approved at best.
It takes about a month to get P3 from NVC.
It will be Apr/May. If you send it soon, you may get
interview aroung Jul.

You may delay sending P3. Few of my friends have got P3
4 months ago & did not send so far. They put it on hold to get married first.

I140

if my recollection is correct, you can send your application for I 140 now. Your CP interview will only be scheduled only after u send you P3 to the consulate. Also you should not send your P3 to the consulate before your I 140 is approved.
So after ur I 140 is approved, you can send ur P3 anytime based on when you want your interview and what the approximate time for scheduling the interview is after the P3 is delivered at that specific consulate.

filed I-140 today

My attorney filed my I-140 today and said that delaying sending Packet 3 back to NVC or direct to Sydney Consulate as suggested on this board is a good way to try to obtain an interview at a desired time. Thanks for your advice.

Remember the time limit...

Hello,

congrats on filing your I-140. Do remember that after I-140 approval for CP your file will be transferred to NVC. NVC will send you packet 3. To best of my knowledge, you must apply for consular processing within 1 YEAR of your receiving packet 3. I guess that is reasonable and ample time. One has to, at least, plan with that much of margin. good luck!

check on this time limit...with your attoney.

Guys, just a cautionary note

The process for CP seems to be changing although I\'m not sure when this is being enforced. NVC sends a couple of forms (first something about appointing an agent and then the DS230, etc - although not refered to as pkt 3). These forms are now supposed to be sent back to the NVC (and not the consulate). They verify everything and then forward to the consulate, which schedules an interview. So the strategy may be to delay sending the second part to NVC rather than the consulate. Not sure about the time limits in this case though. Anyways, bottomline is you can kind of control it either way, after getting 140 so go for it.

something to think about (New NVC Process)

As per the old process NVC sent out packet 3 after receiving approval of I-140 and finding that the visa is available and priority date is current. As per the new process NVC will also receive the "packet 3" material and send out to consulates through their secure mail after "checking". Now if some one delays sending this material back to NVC then it may happen that if the visa for that country/group regresses then NVC will hold the material and not send it to consulates. Just a thought for people who may need to delay consular interviews.

Postponing Interview Date

Chennai got my Packet 3 and they say the interview date will not be possible in Jan/Feb. Unfortunately due to pregancy I cannot travel after March. So I should request possibly a June date. Then my big question is will the Consulate maintain my file as active or will my file become dormant. I really concerned about that since inactive files are usually lost. Any ideas!!!

questionandanswer: Request for a specific appointment date in June now itself

It may be a good idea to phone the consulate and explain the reason and ask to schedule in June as convenient for you. Chennai website says interview date may be changed in emergency situations.

You give specific time to them like \'You and your family could only come after May\'

Good luck!
