my PERM labor was applied on May 18, 2010. I received RFE to my labor application in July 2010. My employer responded to the RFE in September 2010. My H1-B is expiring (6 year expiry) including all re-capture days on January 25, 2011. As audited Labor application takes 18-19 months to get approved, it is very unlikely to receive labor approval prior to my visa expiry date. It looks like, I need to travel back to india on or prior to visa expiry date.
my labor will complete 1 year in pending state by May 18, 2011. And then I would be eligible to request 7th year H1-B extension. By that time, I would be present in India.
If my employer applies for 7th year H1-B extension from India, how long usually it takes to receive approved extended H1-B petition? How long it takes if applied via premium processing from India?
