How important is AC21?

I've changed my employer after 190 days of RD. But I never filed AC21.
1. Does that really matters? Will that be a problem during GC stamping?
2. If Yes! then what is the procedure to file AC21?
3. Do I need an Attorney or can I file directly by myself?

Earlier I never knew about AC21. I don't have an attorney. Please help me out I'm really worried.

Thanks!

AC21 is not a BCIS form that you submit. It's an immigration act that allows you to change employers when your 485 is unadjudicated for 180+ days. Your new job has to be in the same or similar category as your LC. If you get an RFE for employment letter, pay stubs, etc. just get that from your new employer. You don't have to do anything right now. If you get approved without an RFE that's the end of the story. You're a free bird after that. Hope that helps.

" Free Bird " Do you mean once he wud get his GC approved, he will be free to switch job as desired, or he wud have to work with that second employer for certain period ?

Wud appriciate input ..

It would be nice to work for that new employer at least for a certain period, say 6 months or so, but there's no rule that prevents you from changing employers.

Dear mavishka,

Thanks! for the information. I just contact Sheela Murthy for AC21 and I got a reply from one of her Attorney saying that... I've to pay $1500 for Attorney fee and $100 for AC21. Do u think it is worth going thru Sheela Murthy? I also heard from one of my friend that, I don't have to do anything till a Query comes. But another friend said that Its mandatory to inform INS regarding change of Employer (AC21), since I've changed job after 190 days, otherwise it will be a problem.

Please guide me...

Why waste money on a problem that has not yet occured. It is not mandatory to inform INS when you change jobs after 180 days. If you get a RFE respond to it by yourself showing that the job change occured after 180 days, current paystubs and current job description. If that fails then contact a lawyer...

Jibran,
Thanks! a lot for your advice. I'll follow that. Right now I cannot effort any more money. Already I've spent a lot from my pocket.
