well I bet most of you are pretty sick and tired of my case threads and its been since June 06' (filing as well) but now ive crossed the line and done something well not legal lol, heres why.
In March of 2007, I received word from my congressman that my I-485 has been rejected but my I-130 was approved and that I would receive a denial letter real soon and so I waited.
In May of 2007, I contacted my Congressman again and she couldn't find a reason why I didnt receive the Denial letter but I had a feeling so I did some researched. After, figuring out the name of the person who denied my case (I wont say who due to possible lawsuit), I researched the person name through the internet and went all out just to get in contact with. At first I found a number to the Detroit District directory line where it was posted two years ago online from a congressman web-site (the site has been closed and the phone number has been changed), I used that number and talked to some woman that was kind enough to give me a private line towards the director of the Detroit District office (she told me not to share), so I used it and the director picked up the phone and I sounded like I knew I was talking about and gave out the name who I wanted to speak to and she gave me the number of the Officer who denied me. I called the number and the person who I spoke to was the guy who denied me and he explained why and that I can appeal it if I wanted to. He then said that he sent the Denial back in April but to the wrong address, he then re-filed the Denial notice and sent it in late May.
In June 2007, I received the denial notice and immidentally contacted a lawyer and filed a motion to reconsider. I provided 59 pages of evidence to show why I should be reconsidered. (I was denied cause I previously had a green card back in 1996 but through a different sponsor in which my mom divorced and moved back to Canada, they found on record that I never "cleared" my status and that i could be using it still and living in the U.S. illegally but that isn't true).
Now, after 4 months. I contacted my congressman and she again tried to get a hold of Immigration but they refused to give out any information so I did the unthinkable and called the officer who denied me. The Officer told me he wanted to speak to my Step-Father to ask him some questions so to have him call him. My step-father then called and the officer said he wants to have an interview in two weeks and to NOT have me come to the interview.
Now my lawyer says this is great news cause this could be the last step in this appeal, however what is really strange is that I am not allowed to come to the interview, in which I did all the paper work and know more about my case then anyone else. It is extremely odd but i am happy something is going forward but I do advise people to step up and do whatever you can to make your voice heard, if you ever been denied or in a FBI clearance..etc. make sure you take down the officer's name and write to him to get you case moving. Infact, write not only to the officer but to other government parties so they can contact the person who is keeping your case on hold. What I did is illegal, in fact I was threaten once by another officer that if I called again I would be pursued in some legal action (directory line) and to make an INFOpass.
I hope the 2nd interview works out, most of all I think what the officer wants to know is why my mother is not in the U.S. and why she is banned for 5 years. My lawyer says its tricky however after reading several documents about cases, my mother's ban should not effect me...especially when im 19 years old.
